The request for suspension presented to the President of the Supreme Court is referred to the Court by him. The request of the special prosecutor to treat the request for suspension as a petition for certiorari is granted, and this request is granted limited to the following issue:

Whether and to what extent a former president enjoys presidential immunity from criminal prosecution for conduct allegedly involving official acts during his or her time in office.

Without ruling on the merits, this Court directs the Court of Appeals to continue to suspend the issuance of the warrant until this Court’s ruling is rendered. The request for suspension is rejected as questionable.

The case will be submitted for oral argument during the week of April 22, 2024. The appellant’s brief on the merits and any amicus curiae brief supporting or supporting either party must be filed by Tuesday, March 19, 2024. The brief on the merits of the defendant, as well as any supporting amicus curiae briefs, must be filed by Monday 8 April 2024. Any reply brief must be filed by 5pm on Monday 15 April. , 2024.
