The Fifth Circuit Court of Appeals has granted a temporary stay of a federal judge’s decision to suspend for a week a Texas law that allows police to arrest illegal immigrants.
The appeals court ruling will remain in place unless the Supreme Court intervenes by March 9.
U.S. District Judge David Ezra, a Reagan appointee, issued a temporary injunction Thursday that blocked a Texas law that gave local police the power to arrest illegal aliens.
“The preliminary injunction granted by U.S. District Judge David Ezra puts on hold a law that was supposed to take effect March 5 and came as President Joe Biden and his likely Republican challenger in November, Donald Trump, were visiting the southern border of Texas to discuss immigration. Texas authorities are expected to appeal.” – reports ABC News.
In December, Gov. Greg Abbott (right) signed a bill giving Texas police the power to arrest illegal aliens during Biden’s border invasion.
“Biden’s deliberate inaction has left Texas to fend for itself,” Abbott said, adding that the new bill is designed to “stop the tide of illegal entries into Texas.”

Far-left “civil rights” organizations like the ACLU have filed lawsuits to stop Abbott’s new law.
“Ezra wrote in his decision that allowing Texas to “permanently supersede federal directives” due to invasion would amount to the nullification of federal law and authority – a notion that is antithetical to the Constitution and has been unequivocally rejected by federal courts starting from the Civil Civil Code. War.’” ABC News reported.
The federal appeals court stayed Ezra’s injunction.

The 5th U.S. Circuit Court of Appeals on Saturday overturned a lower court’s ruling that blocked a new state law that allows Texas police to arrest people suspected of illegally crossing the Texas-Mexico border.
The New Orleans appeals court immediately suspended its order for seven days to give the federal government time to appeal to the U.S. Supreme Court. If the higher court doesn’t intervene, the new law could take effect Saturday as the legal battle continues.
The appeals court also said it will schedule oral arguments for the next available date. As of Monday, that date has not been announced.
The 5th Circuit’s ruling came a day after U.S. District Judge David Ezra in Austin blocked Senate Bill 4 from taking effect, saying the law “threatens the fundamental idea that the U.S. they must regulate immigration with one voice.”
