Aileen Cannon toys with Jack Smith as she refuses to drop Trump charges

Judge Aileen Cannon denied Trump’s motion to dismiss the criminal charges based on the Presidential Records Act, but also declined to rule on jury instructions.

Lawfare’s Anna Bower posted:

Of course, Cannon would not have dismissed the charges against Trump based on the Presidential Records Act, because Trump and his lawyers are relying on a completely made-up interpretation of the Presidential Records Act and the opposite of what the law does.

However, Smith wanted a ruling on the jury instructions so he could immediately appeal if Cannon decided to instruct the jury to consider Trump’s false interpretation of the Presidential Records Act in their deliberations. Smith wanted this sentence so that Cannon could not tilt the jury in Trump’s favor with his instructions.

Cannon’s refusal to rule is more of a game.

The judge is trying to drag these proceedings beyond the presidential election to help defendant Trump.

Without a ruling, Special Prosecutor Smith is stuck for now. He cannot appeal to the 11th Circuit until Cannon reigns.

Aileen Cannon is joking. Legal experts expressed the firm belief that if she tried to influence the jury with Trump’s favorable instructions, she would not only be overruled on appeal, but the special prosecutor would have reason to have her removed from the case.

It’s time for Judge Cannon to go. She knows this, and that’s why she refuses to issue a sentence that could get her kicked off the case.
