Radically liberal singer Cher broke down in court this week before a judge denied her request for emergency temporary guardianship over her 47-year-old son Elijah Blue Allman.

People Magazine reported that Cher, 77, couldn’t help but get emotional about her son’s well-being as his lawyers expressed concerns about his health and safety. Her lawyers told the judge that she only made the request because she believes Allman’s situation has become serious and that she wants to manage the money he is owed from her trust to ensure it is managed for his benefit. of him.
Cher’s lawyer said she “feared her son would not be alive within the year” due to two ongoing issues: his “history of drug use” and his diagnosis of “schizoaffective disorder.” She also expects to receive a bipolar diagnosis for Allman from a “leading physician.”
“Cher was told by doctors that if he didn’t take this step like his mother, he would end up back on the streets,” his lawyer said.
Cher doubles
Although Allman said in an objection to his mother’s request that he received addiction treatment, Cher’s lawyers said she is more concerned about her son’s history of mental illness.
“[Drug use] it is the secondary issue, it is the issue of mental illness that makes Mr. Allman vulnerable,” they argued. “He IS surrounded by people who deny the mental illness component.”
Cher’s lawyers also revealed that Allman had been placed on several 5150 holds, which is a legal code in California that “allows a person with a mental illness to be detained involuntarily for a 72-hour psychiatric commitment.” The most recent arrest occurred in September, when a supposedly sober Allman experienced a “psychotic episode.”
“We are trying, your honor, to avoid this situation where her life is at risk,” Cher’s lawyer said, adding that the Grammy-winning singer is “very open” and would “absolutely agree” to a “trustee third-party professional”. ” having been appointed Allman by the court.

The judge rules against Cher
Unfortunately for Cher, though, the judge ultimately denied her request.
“I have no doubt that Cher’s concerns are driven by concern for her son. I do not think so [Allman] questions about that,” the judge said, adding that there was “insufficient evidence” to accept temporary guardianship because much of what the singer’s legal team was arguing was based on “fears” and hypotheticals.
“This in itself does not constitute a basis for the court to appoint a probate trustee. To date I have not seen the evidence to grant temporary, emergency guardianship,” the judge continued.
The judge concluded that Allman “managed his finances” and “has an apartment,” and “remained drug-free” after undergoing “several drug tests.”

Judge concludes hearing – Allman celebrates
The judge concluded the hearing by saying it will resume with a further hearing on March 6, as the proposed conservatorship case is still pending.
Allman immediately celebrated the legal victory over his mother.
