The U.S. Supreme Court last week allowed Texas to enforce immigration law that allows police to arrest illegal aliens.
The Supreme Court’s conservative majority rejected an emergency request from the Biden regime asking the high court to block Texas immigration law.
The High Court temporarily rejected the Biden regime’s request as the litigation made its way through the courts.
Last week, the Fifth Circuit Court of Appeals temporarily suspended the immigration law after the Supreme Court rejected an emergency request.
On Tuesday evening, a three-judge panel of the Fifth Circuit, in a 2-1 ruling, rejected the “invasion” claims and issued a new hold on Texas immigration law.
The only dissenting judge was appointed by Trump.
The AP reported:
Texas plans to arrest migrants suspected of entering the United States illegally will remain on hold under a federal appeals court order that likely blocks enforcement of Republican Gov. Greg Abbott’s new immigration law until a larger decision will be made about its legality.
Tuesday’s 2-1 ruling is the second time a three-judge panel of the 5th U.S. Circuit Court of Appeals has temporarily stayed the Texas law. After a few confusing hours, the Supreme Court last week allowed the law to take effect, sparking anger and anticipation along the U.S.-Mexico border.
In Tuesday’s order, Chief Justice Priscilla Richman cited a 2012 Supreme Court decision that struck down parts of a strict Arizona immigration law, including the power of arrest. The Texas law is considered by opponents to be the most dramatic attempt by a state to control immigration since the Arizona law.
“For nearly 150 years, the Supreme Court has held that the power to control immigration – the entry, admission and deportation of noncitizens – is exclusively a federal power,” wrote Richman, an appointee of the Republican president George W. Bush.
In December, Gov. Greg Abbott (right) signed a bill giving Texas police the power to arrest illegal aliens during Biden’s border invasion.
“Biden’s deliberate inaction has left Texas to fend for itself,” Abbott said, adding that the new bill is designed to “stop the tide of illegal entries into Texas.”
“Today at the Texas-Mexico border for a bill signing ceremony that will take #OperationLoneStar to the next level,” Abbott said on X in December.
