Netlist (OTCQB:NLST) lost an ongoing dispute with Samsung (OTCPK:SSNLF) and Micron (MU) when an administrative tribunal ruled that one of its patent claims was invalid.
The Patent Trial and Appeal Board determined that this is claim 16 of the ‘912 patent it is not patentable, according to a dominant on Wednesday by the administrative court.
The patent infringement complaint involves printed circuit boards, memory modules and dual-date memory, or DDR.
The decision comes after the PTAB said in June that there is a reasonable likelihood that Micron (MU) will be able to demonstrate that a claim in Netlist’s patent lawsuit (known as the ‘912 patent) is unpatentable.
Samsung (SSNLF) and Netlist (OTCQB:NLST) have been fighting over patent rights to memory module technologies since a 2015 joint development and licensing deal ran into problems about three years ago. Netlist formally ended the licensing agreement in mid-2020. Netlist is also involved in patent lawsuits with Google (GOOGL) over patents.
