ChatGPT-Creator OpenAI refuted the claims of Elon Musk for what concern existence of a “constituent agreement” for the company’s non-profit status and non-disclosure of source code.
What happened: OpenAI, a company backed by Microsoftwhich was co-founded by Musk in 2015, has rejected allegations made by the tech billionaire in a lawsuit filed against them, CNBC reported.
In a document filed in the California Superior Court for the County of San Francisco, OpenAI said: “There is no incorporation agreement, or any agreement with Musk, as the complaint itself makes clear.”
“The founding agreement is instead a fiction that Musk conjured up to undeservedly claim the fruits of an enterprise that he initially supported, then abandoned, then saw succeed without him,” it reads.

In the lawsuit, filed earlier this month, Musk alleged that an “establishment agreement” existed between him and two other OpenAI co-founders in 2015. Sam Altmann AND Greg Brockmannwhich stipulated that the AI Lab would operate on a non-profit basis and would not keep information private for profit.
He claimed that OpenAI violated this agreement by releasing the file GPT-4 large language model without providing scientific details for public consumption.
However, the manufacturer of ChatGPT has denied the existence of such an agreement. The company called Musk’s case frivolous and said Musk himself supported a for-profit structure for OpenAI.
“Seeing the remarkable technological advances achieved by OpenAI, Musk now wants that success for himself,” the document reads. “He then brings this action accusing the defendants of breaching a contract that never existed and of duties that Musk was never owed, seeking damages calculated to benefit a competitor of OpenAI.”
Because matter: Following Musk’s lawsuit, OpenAI investor Vinod Khosla characterized the lawsuit as a “hello to a bruised ego,” suggesting that Musk’s decision to sue was driven by his ego rather than any legitimate grievance.
Previously, it was also revealed that Musk had once suggested that OpenAI was the only way to compete Alphabet Inc.‘S Google came about through a merger with Tesla. However, his proposal was not received with much enthusiasm and he left parent ChatGPT in 2018.
Meanwhile, Musk announced that his venture into artificial intelligence, xAIwill make its AI chatbot code open source Grokthis week, also throwing shade at OpenAI by calling the company itself a “lie.”
