Trump asks Supreme Court to delay Jack Smith case 1/6

Trump has appealed to the Supreme Court and is asking the highest court in the land to delay the sixth of Jack Smith’s case against him.

The Guardian reported:

Donald Trump’s lawyers asked the U.S. Supreme Court on Monday to halt criminal proceedings over his efforts to overturn the results of the 2020 election as he prepares to challenge a recent appeals court ruling that found he was not immune from judicial proceedings.

The former US president met the deadline to seek a stay – imposed by the US Court of Appeals for the DC Circuit – ahead of an expected petition to the country’s highest court on the issue of immunity, which his team envisioned as the best way to delay the upcoming trial.

Trump needs a stay because his lawyers plan to petition the Supreme Court to hear his claim that he has immunity from prosecution. Donald Trump has lost in every court in which he has attempted to claim that he has full and unlimited immunity.

Legal experts have suggested that it is not certain that the Supreme Court will agree to hear Trump’s immunity challenge because there does not appear to be an unsettled question of law. Trump has not won a single case with his immunity claim, and the Constitution, along with legal precedent, appears to be very clear on the limits of presidential immunity.

Trump’s goal is not to win the Supreme Court. The former president is seeking to delay the case until after Election Day.

The 1/6 federal case poses the biggest threat to derail Trump’s presidential campaign before November, which is why he is trying to make sure to block the trial because polls show a conviction would make Trump unelectable.
